ACCIDENT WAIVER AND RELEASE OF LIABILITY

This form must be read carefully, filled out completely and signed by the participant (no faxed or photocopied signatures).

This is a binding legal Agreement. This Agreement is perpetual as long as you are a current participant of Revo Soccer and Amusement Center LLC (herein after “Revo Soccer” or “Company”), Ace Amusements and Festival Center LLC. You have the understanding that Lazerball Soft, Glow Soccer, Glow Basketball, Dodgeball, Time Freak, Augmented Wall Climbing, 5D VR and the arcade games (the “Sport Activities”) are physical activities and injuries might result. As a participant, I acknowledge and agree to the following terms. 

 

Waive & Release/ Indemnify & Hold Harmless

I acknowledge that the Sport Activities test a person’s physical abilities and carry with it the potential for serious injury and even death. The risks include, but are not limited to, those caused by the terrain, facilities, temperature, weather, condition of athletes, structures along/surrounding the participation areas, actions of other people including but not limited to, participants, volunteers, spectators, coaches, event officials, and lack of hydration. In consideration for being permitted by Revo Soccer to participate, I hereby agree as follows:

 

1. I Waive, Release, and Discharge from any and all liability for my death, disability, personal injury, property damage, and property theft the following entities and/or persons: Revo Soccer and Amusement Center, LLC, Ace Amusements and Festival Center LLC, their directors, officers, employees, volunteers, representatives and agents, the event holders, event directors, event coordinators, event sponsors, event staff, event volunteers, property owners (the “Indemnified Parties”); and
2. I Indemnify and Hold Harmless the Indemnified Parties from any and all liabilities or claims made as a result of my participation.

 

Assumption of Risks

Furthermore, I knowingly assume the following risks and understand that there may be other additional risks related to the Sports Activities not listed below which I also agree to assume:

 

1. Injuries from executing strenuous and demanding physical techniques during the Sport Activities;
2. Injuries from the surfaces including bacterial infections and rashes;
3. Injuries resulting from falls to the ground due to uneven or irregular terrain or surfaces;
4. Injuries from collisions with walls, light posts, structures along/surrounding the participation areas, other participants, soccer fields, and equipment;
5. Injuries resulting from failure to properly use any piece of equipment or from the mechanical failure of any piece of equipment;
6. Spinal cord injuries which may render me permanently paralyzed;
7. Injuries from extreme weather conditions which may result in heatstroke, sunstroke or hypothermia;
8. Injuries from contact, colliding or being struck by other participants, spectators, equipment or vehicles;
1. Injuries resulting from vigorous physical exertion and strenuous cardiovascular workouts; and
10. Injuries from exerting and stretching various muscle groups.

 

COVID-19

I agree that I am personally responsible for my safety and actions while at Revo Soccer. I agree to comply with all Miami-Dade policies and rules. Because Revo Soccer is open for use by other individuals, I recognize that I am at higher risk of contracting COVID-19.

 

With full awareness and appreciation of the risks involved, I, for myself and on behalf of my family, spouse, estate, heirs, executors, administrators, assigns, and personal representatives, hereby forever release, waive, discharge, and covenant not to sue Revo Soccer, its board members, officers, agents, servants, independent contractors, affiliates, employees, successors, and assigns (collectively the “Released Parties”) from any and all liability, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by me related to COVID-19 whether caused by the negligence of the Released Parties, any third-party while at Revo Soccer, or otherwise, while participating in any activity while in, on, or around Revo Soccer and/or using Revo Soccer equipment.

 

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all costs, expenses, damages, claims, lawsuits, judgments, losses, and/or liabilities (including attorney fees) arising directly or indirectly from or related to any and all claims made by or against any of the Released Parties due to bodily injury, death, loss of use, monetary loss, or any other injury from or related to my use of the Revo Soccer facilities, or equipment’s, whether caused by the negligence of the Released Parties or otherwise specifically related to COVID-19.

 

I certify that I do not have any of the following COVID-19 symptoms as outlined by the Center for Disease Control: shortness of breath or difficulty breathing, fever, chills, muscle pain, sore throat, loss of taste or smell. If I develop any of the aforementioned symptoms in the future, I will not attempt to visit the Revo Soccer premises. I certify that neither I nor any member of my immediate family have been advised by health officials to self-quarantine.

 

Minor Participant

All participants under the age of 18 are considered minors and shall be supervised at all times by a parent or guardian. The parent or guardian agrees and understands that he/she is solely responsible for the conduct and safety of the minor. Furthermore, the parent or guardian agrees and understands that Revo Soccer shall not be responsible for any unaccompanied minors or ensuring that they remain on the premises. Parents or guardians are expected to remain with the minor while the minor is participating in the Sport Activities.

 

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in my participation at Revo Soccer. I hereby assert that my participation is voluntary and that I knowingly assume all such risks and further agree to:

 

1. Be solely responsible for any injury, loss or damage that I might sustain while participating in the Sport Activities;
2. Abide by all the rules and regulations as set forth by the Company and to wear at all times proper gear used in protecting my safety from all possible injuries; and
3. Release the Company from liability for any and all claims, demands, actions and costs that might arise out of my participating in the Sport Activities, even though such risks, injuries, loss, damage, claims, demands, actions or costs may have been caused by the negligence of the Company.

 

Medical Treatment: I certify that I am physically fit, have trained sufficiently for participating in the Sport Activities and have not been advised otherwise by a qualified medical person. In the event of an injury, accident and/or illness during participation I hereby consent to receive medical treatment which may be deemed advisable.

 

Photograph/Publication/Video/ Release: I understand that participating in the Sport Activities, I may be photographed, videotaped, or have my likeness reproduced. I agree to allow my likeness to be used for any legitimate purpose by the Company, event holders, producers, organizers and/or assigns.

 

Survival: I further expressly agree that this Accident Waiver and Release of Liability form is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and that if any portion is held invalid, it is agreed that the remaining clauses shall, notwithstanding, continue in full legal force and effect.

 

Acknowledgement

 

I ACKNOWLEDGE THAT I HAVE READ AND AGREED TO THIS AGREEMENT, THAT I HAVE EXECUTED THIS AGREEMENT VOLUNTARILY, AND THAT THIS AGREEMENT IS TO BE BINDING UPON MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS AND REPRESENTATIVES.
