Participant Release, Waiver Agreement, and COVID Screening

Please note, for safety reasons, a paying adult must be inside the room with groups of ages 12 and under.

 

Damage Acknowledgement: In the event that any damage to equipment or facilities occurs as a result of my willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.

    Above the Game LLC, DBA ATG Escape Rooms, hereafter referred to as ATG Escape Rooms, operates and /or conducts room escape team-building experiences. Participating in a room escape experience could result in injuries to the participant. The participant, by executing his or her signature to this release, does hereby release, waive, discharge and covenant not to sue ATG Escape Rooms, its officers, members, promoters, owners, employees, contractors or business partners from any and all liability, injuries, or any and all other claims and damages as a result of participating in an event sponsored by ATG Escape Rooms.

     Furthermore, the participant, on behalf of his personal representatives, assigns, heirs, and next of kin, does hereby release any and all claims, damages, injuries, incurred by the participant in regards to the participation in such events. Participants agree to hereby release any and all claims, of whatever kind of nature, present and future, damages and injuries. Participant assumes full responsibility for and risk of bodily injury, death or property damage due to negligence or non-negligence of ATG Escape Rooms, its, owners, employees or contractors conducting room escape events.

    The undersigned further acknowledges that he/she is voluntarily participating despite the risk of falls, contact with other participants, defective equipment, and the condition of the room. Participant in consideration of being permitted to participate in the escape room experience/ event acknowledges the risks and hazards involved in and arising from the attending, participating in, or as a spectator or bystander of any room escape experience event, but not limited to the additional risks of being hit by flying objects, falling, and does for himself or herself, his or her heirs, executors, administrators, and assigns, release and forever discharge ATG Escape Rooms, their contractors and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death and / or property damage resulting or to result from any accident which may occur as a result of participation in an escape room experience/ event whether by negligence or nonnegligence or from any and all other incidents of harm and /or ill-will.

     You are warned that there may be lasers and laser radiation that could cause injury if any person were to look at it directly with the naked eye and therefore we strongly advise against this behavior. Blacklight and or Strobe Lights may also be used in our rooms and any medical or mental health conditions that could cause a reaction with such light should be brought to the attention of the ATG Escape Room staff immediately and definitely before entering any room. Other objects in the rooms could cause harm if mishandled or misused, therefore we ask all guests to refrain from doing anything that may cause harm or injury to themselves or others.

   I comprehend the risks involved with participating as a spectator or participant. I assume all risks associated with participating in escape room experience/ event including paralysis and death caused by course and contact with other participants or actors. I agree that ATG Escape Rooms or any of its assignees has the right to use my name and or company name on social media marketing and on our website, any photos or any video/sound footage of me during the escape room experience/event. These photos, video footage and sound materials may also be used for any marketing purposes. I fully understand that there are no refunds under any conditions once I purchase my entrance fee and agree to pay for any damages caused by myself or any others minors that I sign to be responsible for.

   Photography and all types of audio/video recording are prohibited inside our game rooms, if you break our recording rules you will be removed from the game and forfeit any entrance fees & you will be required to delete any recordings before you leave our premises. You will be required to hand over your cell phones and cameras to our staff before your game.

You agreed to the following COVID-19 Screening questions:

In the past 14-21 days, you have not had a fever, felt hot or feverish.

In the past 14-21 days, you have not had flu-like symptoms such as gastrointestinal upset, headache, or fatigue.

In the past 14-21 days, you have not had shortness of breath or other difficulties of breathing or a cough.

In the past 14-21 days, you have not had a loss of taste or smell

In the past 14-21 days, you have not had contact with any people with a confirmed case of COVID-19

In the past 14-21 days, you have not traveled outside of the United States to any regions affected by COVID-19 that is banned by CDC.

By signing this form, you acknowledge that you have read & agree to be bound to the terms & conditions set forth on our ATG Escape Rooms Participant Release & Waiver Agreement, which is displayed at reception & on our website. If you do not agree to these terms or they are unavailable then please do not sign and for the safety of our staff and customers, you may not enter, nor be allowed to play.
